Transazione novativa ed ars notaria (di Salvatore Monticelli)


Il tema della transazione in generale e, più ancora, della transazione novativa non riveste una valenza peculiare nell’attività notarle, nel senso che, sotto il profilo eminentemente quantitativo, non avviene di sovente che il notaio sia chiamato a cimentarsi con l’istituto della transazione, se non per l’ipotesi in cui sia chiamato a rogitare una divisione transattiva o una transazione divisoria relativamente a patrimoni essenzialmente immobiliari. Tuttavia l’attenzione del notaio è sollecitata, per i limiti indicati dall’art. 1972, I^ co., c.c. in comb. disp. con l’art. 28 L.N., allorquando lo strumento transattivo è adoperato con riferimento ad un contratto nullo, nonché, all’esito di recenti interventi legislativi, segnatamente dagli artt. 11 e 12 del d.lg. n. 28/2010, in materia di mediazione e conciliazione.

Novative transaction and ars notaria

The subject of the settlement in general and, even more, of the novative settlement does not have a particular value in the activity of noting them, in the sense that, from an eminently quantitative profile, it is not often the case that the notary is called upon to deal with the institution of transaction, except for the hypothesis in which it is called to deed a settlement division or a dividing transaction relating to essentially real estate assets. However, the attention of the notary is requested, for the limits indicated by art. 1972, I ^ co., C.c. in comb. avail. with art. 28 L.N., when the settlement instrument is used with reference to a null contract, as well as, as a result of recent legislative interventions, in particular by Articles 11 and 12 of the legislative decree n. 28/2010, on mediation and conciliation.
