La quantificazione del danno tra fatto e diritto. Brevi annotazioni su risarcimento integrale e compensatio lucri cum damno (di Tommaso Pellegrini)


L'autore indaga il tema della quantificazione del danno muovendo dall'analisi dei principi di "integrale riparazione" e "compensatio lucri cum damno".  La tesi è che la quantificazione del danno, pur potendo apparire una questione di fatto, è in realtà un'operazione marcatamente giuridica. La conclusione viene argomentata anche alla luce della recente giurisprudenza della Corte di Cassazione (Sezioni unite 22-5-2018, nn. 12564-12567). Il principio del risarcimento integrale è in fine affrontato in riferimento al danno non patrimoniale.

Damages quantification between facts and law. Notes on the principles of full compensation and compensation lucri cum damno

The Author investigates the issue of loss and damages quantification, with a focus on the principles of “full compensation” and “compensation lucri cum damno”. Although assessment of damages mainly consists in matters of fact, the Author argues that there is no loss or damage which pre-exists their legal concept and definition. This thesis is supported with the review of recent case-law of the Court of Cassation (Sezioni unite 22-5-2018, nn. 12564-12567). Furthermore, the principle of full compensation is addressed with specific regard to non-pecuniary losses.
