L'Art. 96, 3° comma, c.p.c., costituisce un'ipotesi di punitive damages? Of course! (di Alessandro Mannocchi)


La sentenza n. 11676 del 2013 del Tribunale Civile di Roma ha riproposto il tema dell’ammissibilità nell’ordinamento italiano dei danni punitivi, con riferimento alla disposizione di cui all’art.96, 3° comma, c.p.c.2 , importando dal diritto anglosassone “[…] una forma di danno punitivo per scoraggiare l’abuso del processo e preservare la funzionalità del sistema giustizia. Ciò esclude, come peraltro ben lumeggiato dai lavori preparatori, la necessità di un danno di controparte, pur se la condanna è stata prevista a favore della parte e non dello Stato, al probabile fine di rendere effettivo il recupero della somma e quindi l’afflittività della sanzione […]”. Tale sentenza contrasta con l’orientamento della Corte di Cassazione che ha sempre negato la possibilità di configurare nell’ordinamento italiano i punitive damages, per la contrarietà dell’istituto all’ordine pubblico interno.

Art. 96, paragraph 3 c.p.c., is a hypothesis of punitive damagaes? Of course!

Judgment no. 11676 of 2013 of the Civil Court of Rome re-proposed the issue of the admissibility in the Italian legal system of punitive damages, with reference to the provision of article 96, paragraph 3, cpc2, importing from Anglo-Saxon law "[...] a form of punitive damage to discourage abuse of the trial and preserve the functionality of the justice system. This excludes, as is well highlighted by the preparatory work, the need for damage to the counterparty, even if the sentence was provided for in favor of the party and not the State, in order to make the recovery of the sum effective and therefore the afflictivity of the sanction [...] ". This ruling contrasts with the orientation of the Court of Cassation which has always denied the possibility of configuring punitive damages in the Italian system, due to the institution's opposition to internal public order.
