Vizi del consenso e contratti aleatori: annullabilità per errore del contratto di scommessa (di Daniele Scuto)


Il contributo analizza le sentenze rese dalla Corte d’Appello di Firenze (sent. 11 luglio 2017, n. 1600) e dalla Corte d’Appello di Roma (sent. 17 ottobre 2016, n. 6126) che rappresentano i primissimi casi in cui la giurisprudenza, riconoscendo la sussistenza e la riconoscibilità dell’errore materiale ex art. 1428 e ss. c.c., ha annullato i contratti di scommessa stipulati nell’ambito delle scommesse telematiche. Dopo aver illustrato il caso concreto e previa una breve disamina dei requisiti essenziali del tipo contrattuale in esame, l’Autore analizza i punti focali delle due pronunce al fine di individuare gli indici valorizzati dalla giurisprudenza di merito per l’annullabilità per errore materiale del contratto di scommessa. 

Annulment of a bet agreement due to mistake

The essay analyzes two rulings issued by the Florence Court of Appeal (sentence 11 July 2017, no. 1600) and by the Court of Appeal of Rome (sentence 17 October 2016, no. 6126), which represent the very first cases in which the Italian courts have considered a bet contract stipulated in the context of telematic betting invalid, pursuant to articles 1428 and following of the Italian Civil Code. After having illustrated the specific cases and after a brief examination of the essential requirements of the type of contract in question, the Author analyzes the focal points of the two rulings in order to identify the indices considered by the relevant jurisprudence for the annulment of the contract due to material error.
