El dańo extrapatrimonial en el nuevo código civil (di Juan Carlos Boragina, Jorge Alfredo Meza)


El nuevo Código Civil y Comercial considera que habrá daño extrapatrimonial cuando se afecte un derecho subjetivo de tal naturaleza, que tenga “proyección moral”, o toda vez que se lesione un interés extrapatrimonial, susceptible de reparación, ampliando la legitimación de los damnificados indirectos,  a título personal, –cuando del hecho deriva la muerte o una gran discapacidad de la víctima - a los ascendientes, a los descendientes, al cónyuge o a quien conviva con la víctima recibiendo trato familiar ostensible.

Non-pecuniary damage in the new civil code

The new Civil and Commercial Code considers that there will be extra- pecuniary damage when a subjective right of such a nature is affected, having a “moral projection”, or whenever  an  extra- pecuniary interest, subject to reparation, is injured, enhancing  the legitimacy of the indirect victims, in a personal capacity, –when death or a great disability of the victim comes from the event itself– to the ascendants, to the descendants, to the spouse or whoever lives with the victim  receiving ostensible family treatment.
