El Código Civil y Comercial de Argentina se fundamenta en valores contenidos en principios que integran normas abiertas o generales. Como consecuencia de la imposibilidad de regular todas las distintas tendencias de comportamiento de un pueblo conformado por inmigraciones muy distintas la casuística no es lo preponderante. Esa convivencia de diferencias ha provocado el denominado vigor híbrido que es consecuencia de construir respetando y armonizando los aportes distintos. Entre los precedentes jurídicos de aquellos países que inciden en la evolución del derecho que rige en Argentina, el de mayor transferencia es el Codice Civile de Italia de 1942, cuya influencia resulta, entre otras muchas normas, de lo que regula respecto a la revisión del contrato por excesiva onerosidad; el principio de equidad; el incumplimiento imputable y el abuso del derecho.
The Civil and Commercial Code of Argentina is based on values contained in principles that integrate open or general rules. As a consequence of the impossibility of regulating all the different behavioral tendencies of a people made up of very different immigrational backgrounds, case by case consideration is not the predominant factor. This coexistence of differences among the population caused the so-called hybrid vigor which is the consequence of building upon respecting and harmonizing different contributions. Among the different legal precedents of those countries that affect the evolution of the law that governs Argentina, the one with the greatest transfer is the Italian Codice Civile of 1942, whose influence results, among many other rules, from what regulates the revision of the contract based on excessive onerosity; the principle of equity; attributable breach and abuse of rights.
