La natura: sujeto de derechos? (di Livio Perra )


Nel presente lavoro, l’autore al fine di comprendere se nell’ordinamento italiano sia possibile apportare una tutela efficace in materia ambientale, con il riconoscimento della Natura come soggetto di diritti, si propone di valutare i fondamenti, le tappe che hanno portato a questa concezione in Ecuador e Bolivia. A tal fine, esamina il concetto del Buen Vivir / Vivir Bien e come la cosmovisione andina ha influenzato il diritto dei due Stati. In seguito, passa in rassegna i diritti della Natura. In particolare, osserva che i diritti della Natura non possono essere diritti soggettivi, ma essi possono essere tutelati dagli esseri umani, attraverso l’istituto della rappresentanza e adeguate azioni esperibili. Infine, considera gli spunti che il legislatore italiano potrebbe trarre dalle teorie andine per la tutela dell’ambiente: ispirarsi agli ordinamenti giuridici di Ecuador e Bolivia, per riconoscere la Natura come titolare di diritti. Questo potrebbe fornire una efficace soluzione e risolverebbe i vuoti di tutela ora presenti nel nostro ordinamento giuridico.

Nature: subject of rights?

In this paper, in order to understand if in Italian law there is some possibility of making effective the environmental protection with the recognition of Nature as a subject of rights, the author sets out to evaluate the basics, the steps that led to this conception in Ecuador and Bolivia. For this purpose, he examines the concept of Buen Vivir / Vivir Bien and how the Andean worldview influenced the laws of both Countries. Later, he analyses the rights of Nature. In particular, he observes that the rights of Nature cannot be subjective rights, but they can be protected by human beings, through the institution of representation and adequate actions available. Finally, he considers the ideas that the Italian legislature could draw from the Andean theories for environmental protection: inspiration to the legal systems of Ecuador and Bolivia, to recognize Nature as titulary of rights. This could provide an effective solution and solve the gaps in the protection in our legal system.
