L’articolo esamina alcuni problemi riguardanti il drafting delle disposizioni legislative, con particolare riguardo al rapporto tra termini e significati. Si sottolinea l’opportunità di non usare una parola in differenti significati e di non usare termini diversi con un medesimo significato. Per la comprensibilità delle disposizioni legislative occorre anche valutare la scelta di termini appartenenti al linguaggio ordinario, o di termini tecnici del linguaggio giuridico o appartenenti ad altri linguaggi specialistici.
The article examines some problems concerning the drafting of statutory provisions, focusing on the relationship between the terms and concepts used by the legislator. It stresses the relevance of not using a word in different meanings and not using different terms with the same meaning. It also considers for the comprehensibility of statutory provisions the need to assess whether to choose terms belonging to ordinary language or technical terms of legal language, or terms belonging to other specialised languages.
