L'articolo indaga la discussa natura giuridica del diritto di sopraelevare nel condomino, previsto dall'art. 1127 c.c., e si interroga di conseguenza sul regime che governa l'alienazione di tale diritto in favore di terzi diversi dal condomino avente diritto alla sopraelevazione, altresì analizzando i riflessi delle diverse possibili ricostruzioni sul piano sia della pubblicità immobiliare e della trascrizione, sia della prescrittibilità del diritto alienato.
The article investigates the controversial legal nature of the right to elevate in an apartment block (condominio), provided for by Article 1127 of the Civil Code, and consequently questions the rules governing the transfer of this right in favor of third parties other than the apartment owner having the right to elevate constructions. It also analyzes the impact of the various possible reconstructions of this right in terms of both land registration of the transfer and prescription (or time limitation) of the transferred right.
