L’osservazione della realtà consente di enucleare una variegata casistica ove dall’inadempimento o, più probabilmente, dall’adempimento inesatto di un obbligo informativo consegua non solo una responsabilità contrattuale nei confronti del soggetto creditore dell’informazione, ma anche una responsabilità nei confronti di soggetti terzi, rispetto al predetto rapporto obbligatorio, che su quella informazione abbiano fatto incolpevole affidamento. È con riferimento a tali ipotesi che si pone il problema dell’individuazione di un criterio discriminante per la riconduzione delle responsabilità in questione nell’alveo della responsabilità aquiliana, o, piuttosto, in quello, ben più protettivo e garantista per il terzo che abbia confidato nella esattezza dell’informazione in questione, della responsabilità contrattuale cd. da contatto sociale.
Observing reality allows us to identify a variety of cases where the non-fulfillment or, more likely, the incorrect fulfillment of an information obligation leads not only to a contractual responsibility towards the creditor of the information, but also a responsibility towards third parties, with respect to the aforementioned mandatory relationship, who have made innocent reliance on that information. It is with reference to these hypotheses that the problem arises of identifying a discriminating criterion for bringing the responsibilities in question back to the aquilian liability, or, rather, to that, much more protective and guaranteed for the third party who has confided in the accuracy of the information in question, of the so-called contractual liability. from social contact
