Legal training aims not only to convey legal knowledge to the student but – more importantly – also legal thinking, since lawyers across the world must be persuasive if the legal situation is unclear or disputed. Although harmonisation of legal training in the Member States of the European Union is still a long way off, there should be a minimum canon of legal techniques which should be conveyed to trainee lawyers everywhere across Europe and across the world. This article aims to spark a discussion about such a minimum canon, the hermeneutics of facts, legal interpretation and legal construction, and also working with the Constitution and European law.
Il saggio si propone di contribuire alla riflessione sulla necessità – particolarmente nella formazione dei giuristi - di adeguare metodo di indagine e canoni interpretativi alle trasformazioni dei diritti interni degli Stati membri nel quadro del diritto e della costituzione dell’Unione europea.
