Il lavoro propone un'indagine sulla prelazione ereditaria che, ripercorrendo l'evoluzione storica dell'istituto, ne verifica l'attuale coerenza sistematica. L'analisi, individuato il fondamento assiologico del diritto di prelazione e del diritto di riscatto e la funzione riaggregativa di assetti proprietari a essi assegnata, riconosce rilievo privatistico agli interessi protetti. Lo studio si conclude, quindi, con l'esame delle questioni ermeneutiche ancora aperte in dottrina e in giurisprudenza, con particolare riferimento alla rinunciabilità e alla trasmissibilità dei diritti in discorso, prospettando soluzioni critiche rispetto agli ultimi arresti giurisprudenziali.
The work proposes an investigation into the hereditary pre-emption which, retracing the historical evolution of the institute, verifies its current systematic coherence. The analysis, having identified the axiological foundation of the right of pre-emption and the right of redemption and the re-aggregative function of ownership structures assigned to them, recognizes private importance to the protected interests. The study therefore concludes with the examination of the hermeneutical questions still open in doctrine and jurisprudence, with particular reference to the renunciation and transmissibility of the rights in question, proposing critical solutions with respect to the latest jurisprudential arrests.
