“Contatto sociale” e affidamento, attori protagonisti di una moderna commedia degli equivoci (di Alessio Zaccaria)


Per “contatto sociale”, s’intende qualsiasi forma d’interrelazione fra due o più soggetti che si collochi in un ambito definibile, appunto, come sociale.

Il “contatto sociale”, lì dove “qualificato” in considerazione delle qualità proprie del soggetto con il quale si sia avuta l’occasione di relazionarsi, e perciò in quanto generatore di affidamento, è stato considerato fonte di “obbligazioni senza prestazione” (rectius, si dovrebbe dire di “obbligazioni senza dovere primario di prestazione”: obbligazioni senza prestazione non sono configurabili per difetto di un elemento essenziale, la prestazione, appunto).

In realtà, non tutti i “contatti sociali” possono essere classificati quali fonti di obbligazioni. In questi termini, sono inquadrabili i “contatti negoziali” e i “contatti simili ai contatti negoziali”, in virtù di quanto previsto nell’art. 1337 c.c. Perché anche i “contatti sociali” diversi sia dai “contatti negoziali” sia dai “contatti simili ai contatti negoziali” possano essere definiti come fonti di obbligazioni, il semplice affidamento non basta: occorre un “mediatore giuridico” in grado di svolgere lo stesso ruolo che con riguardo alle altre due specie di “contatti” svolge l’art. 1337 c.c.

“Social contact” means any form of correlation between two or among more subjects, inserted in a context that can be defined exactly as social.

The “social contact”, where “qualified” in consideration of the specific qualities of the subject with whom a relationship has been built and, hence, as generator of entrustment, has been considered as source of “obligations without performance” (rectius, it is deemed better to say “obligations without primary duty of performance”: obligations without performance cannot be considered as such due to the lack of an essential element, exactly the performance).

Truthfully, non all the “social contacts” can be classified as sources of obligations. In this framework the “negotiating contacts” and the “contacts similar to negotiating contacts” can be included, according to the provision at article 1337 Civil Code. With the aim to define as source of obligations also the “social contacts” different from the “negotiating contacts” and from the “contacts similar to negotiating contacts” the simple entrustment is not sufficient: a “juridical mediator” is needed, one that is able to carry out the same role that article 1337 undertakes with regard to the other two types of “contacts”.
