Tra Public and Private enforcement: il valore probatorio dei provvedimenti dell´AGCM alla luce della nuova direttiva 104/14 e del d.lgs. 3/2017 (di Laura Miccoli)


L'articolo in esame, al fine di comprendere gli obiettivi che la Direttiva 104/14 si propone di conseguire, ripercorre la distinzione tra public and private enforcement.
Il primo concetto richiamato rievoca l’interesse europeo alla libera circolazione delle persone, delle merci e dei capitali. L’azione delle misure di public enforcement, infatti, mira alla massimizzazione del benessere della categoria dei consumatori in sé considerata, nonché alla tutela delle istanze imprenditoriali a competere in un libero mercato. La dimensione coinvolta, dunque, è spiccatamente macroeconomica.
Per quanto concerne, invece, il concetto di private enforcement, viene presa in considerazione un’ottica puramente individuale, che pone l'accento sulla regolamentazione della singola operazione commerciale.
La conseguenza pratica della suddetta distinzione è rinvenibile nei rimedi concessi al soggetto danneggiato da una condotta anti-concorrenziale.
Nella eventualità in cui siano lesi interessi afferenti alla sfera macro-economica, è infatti possibile adire l’Autorità antitrust, ferma restando la facoltà di impugnare tali decisioni di fronte all'Autorità giudiziaria in sede di giurisdizione esclusiva, ai sensi dell’art. 133 c.p.a. comma 1 lettera l.

Il paper analizzerà la Direttiva Europea e il D.lgs. 3/2017 al fine di comprendere se la materia è stata adeguatamente sistematizzata, riuscendo a sfruttare le sinergie tra le due tipologie rimediali.

Between public and private enforcement: the probative value of the Italian Competition Authority's measures, in light of European Directive 2014/104/EU and Legislative Decree n. 2017/3.

The Paper traces the distinction between public and private enforcement, in order to understand the objectives that Directive 104/14 proposes to achieve.

The first concept recalled evokes the European interest in the free movement of people, services, goods and capital. The action of public enforcement measures, in fact, aims at maximizing the consumer well-being, as well as protecting entrepreneurial requests to compete in a free market. The dimension involved, therefore, is distinctly macroeconomic.

As regards, however, the concept of private enforcement, a purely individual perspective is taken into consideration, which places the emphasis on the regulation of the individual commercial operation.
The practical consequence of the aforementioned distinction can be found in the remedies granted to the person injured by anti-competitive conduct.
In the event that interests pertaining to the macro-economic sphere are harmed, it is indeed possible to lodge a complaint to the Antitrust Authority, without prejudice to the right to appeal such decisions before the judicial authority, according exclusive jurisdiction, pursuant to art. 133 c.p.a. paragraph 1 letter l.

Otherwise, if the micro-economic dimension is compromised, the injured party has the right to apply to the civil court to obtain compensation for damage.
It is easy, however, to understand how such remedial separation does not limit the practical consequences deriving from the various actions undertaken: the protection of macroeconomic competition necessarily affects the individual consumption relationship and vice versa, thinking in terms of economies of scale.

The concrete risk inherent to this distinction-fictio is represented by the possibility that unitary or similar events, which should be treated jointly by enhancing the synergies between disciplines, are assigned to different Authorities for functions, attributions and powers.

The paper will analyze the European European Directive 2014/104/UE and  Legislative Decree n. 2017/3  in order to understand  whether it was created an adequate systematic, managing to exploit the synergies between the two types of remedies.
