Error inexcusable y responsabilidad precontractual: el equilibrio entre la tutela del interés del declarante y la protección del contratante lesionado (di Jorge Rodríguez Russo )


En el presente trabajo se examina el problema que presenta el denominado error inexcusable en cuanto al derecho del contratante cuya voluntad ha sido viciada a solicitar la declaración de nulidad y el interés de la contraparte a obtener la reparación del daño provocado por la extinción del contrato. Ante la ausencia de regulación en el Código Civil de Uruguay el tema es examinado a la luz de los principios generales, buscando una solución que contemple el equilibrio entre el interés del declarante y la protección del contratante lesionado.
Inexcusable error and pre-contractual liability: the balance between the protection of interest of the declarant and the protection of the injured contractor
This work examines the problem presented by the so-called error inexcusable regarding the right of the contractor whose will has been corrupted to request the declaration of nullity and the interest of the counterpart to obtain reparation for the damage caused by the Termination of contract. In the absence of regulation in the Civil Code of Uruguay, the issue is examined in the light of general principles, seeking a solution that contemplates the equilibrium between the interest of the declarant and the protection of the injured contractor.
