Il presente contributo intende approfondire gli effetti delle misure adottate in Italia per il contenimento dell’epidemia di Covid-19 sul rapporto tra figli e genitori separati o divorziati allorquando le limitazioni alla circolazione degli individui hanno posto in dubbio la possibilità del genitore non collocatario di frequentare il figlio. Si tratta di un aspetto che non è stato espressamente regolamento dalla normativa emergenziale e sul quale si sono formati orientamenti della giurisprudenza di merito apparentemente contrastanti, che saranno oggetto di esame. L’analisi, volta anche a verificare se eventuali effetti possano avere valenza anche oltre la fase emergenziale, sarà svolta alla luce dei principi generali che governano l’area del diritto di famiglia nonché (nella seconda parte del contributo) sulla scorta di un’analisi comparativa con le soluzioni offerte sullo stesso tema nell’ordinamento inglese.
This essay has the scope to investigate the effects of the measures adopted in Italy for the containment of Covid-19 epidemic on the relationship between children and their separated or divorced parents, with particular reference to the doubts regarding the possibility of the non-foster parent to visit the children under the validity of the restrictions on movement. This is an aspect that the emergency legislation has not expressly regulated and on which conflicting case-law orientations, which will be examined by the author, arose. The analysis, also aimed at verifying whether any effects may be valid also beyond the emergency phase, will be carried out in the light of the general principles governing the area of family law as well as (in the second part of the paper) on the basis of a comparative analysis with the solutions offered on the same issue in the English system.
