L´accertamento dello status del figlio procreato post mortem (di Angela Pagliaro)


La giurisprudenza di legittimità, a seguito di ricorso proposto da una donna al fine di opporsi al rifiuto dell’Ufficiale di Stato civile alla formazione dell’atto di nascita con l’indicazione della paternità, si pronuncia per la prima volta sulla legittimità del suddetto rifiuto ove la nascita avvenga mediante procreazione post mortem a mezzo del seme crioconservato del marito defunto. L’A., dopo un breve excursus circa la presunta illiceità della tecnica procreativa di cui trattasi, analizza i rapporti tra la disciplina di accertamento dello status filiationis prevista dal codice civile italiano, fondata sulla presunzione di concepimento di cui all’art. 232 c.c., e quella di cui all’art. 8 della legge n. 40/2004, fondata sulla manifestazione del consenso alle tecniche procreative nelle forme di cui all’art. 6 della suddetta legge. L’A., in particolare, condividendo la posizione della giurisprudenza in commento e con approccio critico all’anacronistica legislazione italiana in materia, sostiene l’applicazione esclusiva dell’art. 8 l. n. 40/2004 al caso di specie, l’unico in cui non è mai ipotizzabile un contrasto tra favor veritatis e favor minoris, al duplice fine di evitare disparità di trattamento, basate sul momento temporale della nascita, tra figli nati dalla medesima tecnica procreativa e di attenuare le conseguenze pregiudizievoli nei confronti del nato, soggetto totalmente incolpevole rispetto alle scelte genitoriali, il cui preminente interesse è il diritto allo status e all’identità personale. 

Ascertaining the status of a post-mortem procreated child

Following an appeal brought by a woman against the refusal of the civil registrar to issue a birth certificate indicating paternity, the Italian Supreme Court has for the first time ruled on the legitimacy of such a refusal where the birth takes place through post-mortem procreation using the cryopreserved sperm of her deceased husband. After a brief dissertation on the alleged unlawfulness of the procreative technique in question, the author analyses the relationship between the rules on ascertaining the status filiationis laid down by the Italian Civil Code, based on the presumption of conception under art. 232 of the Civil Code, and those of art. 8 of Law no. 40/2004, based on the expression of consent to procreative techniques in the form set out in art. 6 of that law. The A., in particular, sharing the position of the above-mentioned case-law and taking a critical approach to the anachronistic Italian legislation on the subject, argues for the exclusive application of Article 8 of Law no. 40/2004 to the present case, the only one in which a conflict between favor veritatis and favor minoris is never conceivable, with the twofold aim of avoiding unequal treatment, based on the time of birth, between children born by the same procreative technique and of mitigating the prejudicial consequences for the child born, who is blameless concerning to parental choices, whose overriding interest is the right to status and personal identity.
