Il saggio indaga la questione della tutela dei diritti dei terzi di buona fede sui beni sottoposti a misure di prevenzione antimafia, per verificare dove l’ordinamento ha individuato il punto di equilibrio tra l’interesse pubblicistico alla repressione del fenomeno criminale e l’esigenza di tutelare le situazioni giuridiche di soggetti estranei al reato. In quest’ottica, l’Autore procede nell’analisi delle soluzioni approntate dal codice antimafia alla luce anche della legge 24 dicembre 2012, n. 228 (legge di stabilità per il 2013), prestando particolare attenzione alla sorte dei diritti dei terzi successivamente al provvedimento di confisca, con riferimento alle procedure già iniziate alla data di entrata in vigore del codice antimafia. Viene analizzata infine la soluzione offerta dalle Sezioni unite del 2013 sui rapporti tra ipoteca e confisca.
The essay investigates the question of the protection of the rights of third parties of good faith on assets subjected to anti-mafia prevention measures, to verify where the law has identified the point of equilibrium between the public interest in the repression of the criminal phenomenon and the need for protection of the legal situations of subjects unrelated to the crime. With this in mind, the Author proceeds with the analysis of the solutions offered by the Anti-mafia Code also in light of the law of 24 December 2012, n. 228 (stability law for 2013), paying particular attention to the fate of the rights of third parties following the confiscation order, with reference to the procedures already begun on the date of entry into force of the Anti-mafia Code. Finally, the Author analyses the solution offered by the Sezioni unite of 2013 on the relationship between mortgage and confiscation.
